1. About us
Dunamis Design is a trading name of Dunamis Energi Ltd, a private limited company registered in England and Wales, company number 17038794. Registered office: 128 City Road, London, United Kingdom, EC1V 2NX. Email: [email protected]. In these terms, "we" and "us" mean Dunamis Energi Ltd, and "you" means the business commissioning our services.
2. Who we work with
Our services are for businesses only. By reserving a project you confirm that you are acting for a business, trade or profession and not as a private consumer.
3. Your agreement with us
Our agreement starts when you have accepted these terms and your reservation payment has cleared. It is made up of these terms, the package description on our packages page on the day you reserve, and any written scope we agree with you, which for Flagship Experience projects is a signed scope document. If they conflict, the signed scope comes first, then these terms, then the package description.
4. Prices and payment
- Prices are in pounds sterling. Dunamis Energi Ltd is not VAT registered, so no VAT is added. If we register for VAT in future, VAT will apply only to invoices issued after the registration date, and we will tell you in writing first.
- 30% of the project price reserves your production slot.
- 40% is due when you approve the creative direction.
- The final 30% is due before launch. Your website goes live once this payment has cleared.
- Invoices for the second and final payments are due within 7 days. If a payment is late, we may pause work until it clears, and the delivery timeline pauses with it.
- Payments are taken by our payment provider on its own secure checkout page, or by bank transfer against our invoice. We never ask for card details by email.
5. Delivery times
Delivery times are stated in business days and begin only when all of the following are true: your reservation payment has cleared; you have accepted these terms; your project questionnaire is complete; your written content, the required number of usable images, your logo and brand materials have been supplied and confirmed as suitable; and you have approved the initial creative direction. Delays in content, feedback, approvals, payments or account access pause the timeline for as long as they last.
6. What you provide
- The content, images, logo and information listed for your package, in the formats we ask for.
- One nominated contact who can give feedback and approvals for your business.
- Feedback within 5 business days of each review request. If we hear nothing for 30 days, we may treat the project as paused and agree a new schedule with you.
- You confirm that you own, or have commercial permission to use, everything you supply, and that it does not infringe anyone else's rights.
7. Revisions and changes
Each package includes a set number of revision rounds. One revision round is one consolidated set of feedback, sent together. Extra rounds, additional pages, new functionality, ecommerce, complex integrations and other changes to the agreed scope are quoted separately and start only when you approve the quote in writing.
8. How we make your website
We use professional design and development software, including AI tools, to produce imagery, film and code. Every asset is art-directed and reviewed by us before it reaches your website, and the creative direction, build quality and final result are our responsibility.
9. Ownership
Once your project is paid in full, you own your website, its content and its design. Dunamis Design keeps ownership of its own reusable code, tools and methods, and gives you a permanent, non-exclusive licence to use them as part of your website. Until full payment, everything we create remains ours and is licensed to you only for review.
10. Our portfolio
After launch we may show your website in our portfolio and case studies. If you would rather we did not, tell us in writing and we will not.
11. Third-party services
Hosting, domains, booking tools, form services, payment providers and other third-party services are provided under their own terms and at your cost unless your package says otherwise. We are not responsible for their availability or for changes they make.
12. Post-launch care and Website Care plans
- Every package includes post-launch technical care for 7, 14 or 30 days, as stated for your package.
- Website Care plans are billed monthly in advance and have a three-month minimum initial term.
- After the minimum term, either of us can end a Care plan with 30 days' written notice by email.
- Unused hours do not roll over. We promise response times, not resolution times.
13. Cancellation
How cancellation works, and what is refundable, is set out in our refund policy, which forms part of these terms.
14. Liability
- Our total liability to you under or in connection with a project is limited to the amount you have paid us for that project.
- We are not liable for loss of profits, revenue, business, data or goodwill, or for any indirect or consequential loss.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
15. Confidentiality
We keep your business information confidential and use it only to deliver your project. We ask you to do the same with our proposals and pricing that are not public.
16. Events outside our control
Neither of us is responsible for delays caused by events outside our reasonable control. If that happens, we will tell you and agree a new timeline.
17. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
